Kavanaugh Questioned On Controversial Abortion Opinion

Supreme Court nominee Judge Brett Kavanaugh testifies before the Senate Judiciary Committee during the second day of his Supreme Court confirmation hearing on Capitol Hill September 5, 2018 in Washington, DC.

Feinstein had asked the question in the context of U.S. v. Nixon, the 1974 unanimous Supreme Court ruling ordering then-President Nixon to hand over tape recordings from his White House that ultimately led to his resignation.

"The Brett Kavanaugh hearings for the future Justice of the Supreme Court are truly a display of how mean, angry, and despicable the other side is", Trump wrote on Twitter. Dianne Feinstein (D-CA), made an interesting accusation: saying that he's "beyond pro-gun" and more people would die in mass shooting should he be confirmed. "So sad to see!"

"I think the first quality of a good judge in our constitutional system is independence", the conservative federal appeals court judge said in response to a question by the Judiciary Committee's Republican chairman, Chuck Grassley.

Shrieking protesters also disrupted the hearing.

This is a mockery and a travesty of justice! We can not and should not confirm a justice who believes the president's views carry the day.

Democratic Sen. Dick Durbin of IL asked Kavanaugh if he would seek a delay in his hearing so the paper trail could be vetted.

The New York Democrat used one of the few tools at his disposal by objecting to a routine request to allow committees to meet, forcing the chamber to prematurely adjourn for the day.

Grassley noted that despite his staff being available around the clock to help Democrats access records, not a single Democratic senator showed up.

"Similarly", reasoned Grassley, "we know what kind of judge Kavanaugh will be, because we know what kind of judge he has been for the last twelve years on the most influential circuit court".

But Kavanaugh's nomination languished for three years, as Democrats fumed over his participation in Bush's recount team. Ted Cruz (R-Texas). Richard Blumenthal, D-Conn. "And there will be a lot of heat". Republicans have declined to seek those papers, and instead have gathered documents from his work as White House counsel to Bush.

If confirmed, Kavanaugh is expected to move the court, which already had a conservative majority, further to the right. After Senate Majority Leader Mitch McConnell (R-KY) stole this Supreme Court seat from Merrick Garland, many among the Democratic base have demanded that their elected leaders put up a fight no matter the odds.

On the issue of gun rights, Senator Feinstein pressed Mr Kavanaugh on his previous opposition to a ban on semi-automatic rifles.

Kavanaugh sat, fingers intertwined, quietly staring ahead at the committee members as audience members screamed while being dragged out of the hearing room.

In a tweet Monday, Trump criticized Attorney General Jeff Sessions for the recent indictments of two Republican members of Congress on corruption charges and for the timing, so close to the midterm elections.

Kavanaugh likened Roe v. Wade to another controversial, landmark Supreme Court decision, the Miranda ruling about the rights of criminal suspects. But the Democratic frustrations that boiled over on September 4 had been simmering for more than two years.

Orrin Hatch tried to get the jump on Democrats with questions for U.S. Supreme Court nominee Brett Kavanaugh about allegiance to the president, his relationship with a judge accused of sexual misconduct and separation of powers Wednesday.

But then, with respect to the other question that you're asking, which is about pardons and all the stuff that came up today, it was extraordinary to hear in a Senate Judiciary Committee hearing talk about whether the president can pardon himself, can he be indicted, can he be subpoenaed? He even cited times when justices appointed by Democratic presidents dodged answering how they'd rule on hot-button issues during their confirmation hearings.

The most likely outcome of this week's hearings is a vote along party lines to send Kavanaugh's nomination to the full Senate. The court begins its next term in October.
