Homeland Security Can't Force Asylum Seekers to Wait in Mexico, Judge Rules

"In my 30 years as an agent, I have never witnessed the conditions we are now facing on the Southwest border", said Rodolfo Karisch, chief patrol agent for the Border Patrol's Rio Grande Valley Sector, which is responsible for 320 miles of the almost 2,000-mile USA border with Mexico.

"I'll tell you something: once you don't have it, that's why you have many more people coming", Trump said of migrants and asylum seekers.

The sharp upturn from the winter months, when the figure averaged around 60,000 a month, underscored the ineffectiveness of Trump administration efforts to stem the flow of migrants fleeing endemic poverty and violence in Guatemala, El Salvador and Honduras.

The President wanted families separated even if they were apprehended within the US.

There were approximately 92,000 arrests of undocumented migrants for illegal entry on the southern border in March, up from 37,390 last March.

"Many, many dead people", Trump said, referring to migrants who he said had perished after making the journey.

Trump, who originally dubbed the measure the "Remain in Mexico" policy, unveiled it a year ago as a series of caravans with thousands of Central American migrants made their way to the US-Mexican border.

Meanwhile, amid an ongoing debate about immigration on both sides of the Atlantic, former President Barack Obama told young people at a town hall meeting in Berlin, Germany: "We can't label everybody disturbed by immigration as racist".

There was no immediate reaction from the Department of Homeland Security or Trump on the ruling, which can be appealed. The surge has strained the capacity of border agencies which have been forced to release many migrants once they are processed and given court dates.




The president called on House Democrats to change the loopholes, which allow risky people to get into the U.S.

Judge Richard Seeborg, an Obama appointee, said in his Monday ruling that the policy was too risky in Mexico and that the government cut too many corners.

The anonymous White House official went on to describe plans to revise "credible fear" screening for officials assessing asylum applications.

The White House did not immediately respond to a request for comment.

Rights groups welcomed the ruling on Monday, saying the return policy known as Migrant Protection Protocols (MPP) failed to provide adequate safeguards to protect asylum seekers from persecution.

"The Department of Homeland Security is exercising its statutory authority to help alleviate this humanitarian and security crisis and secure our nation", Nielsen said.

"They don't want to give Trump any victory on anything, ever", said Rep. John Katko, R-N.Y., a member of the House Homeland Security Committee.

The host then threw back to another clip of Trump claiming that he was "the one who stopped" separation.

Law enforcement agents apprehended or turned back 103,492 migrants attempting to reach the US southern border in March, marking the highest month in 12 years. The U.S.is also required to allow named plaintiffs of the lawsuit, who were returned to Tijuana, to enter the country within two days after the order goes into effect.
